How to Verify a Gurgaon Property Before You Pay a Rupee: A First-Time Buyer's Due Diligence Checklist

The average Gurgaon property transaction involves signing documents you have never seen before, trusting timelines that exist only in a brochure, and wiring a sum of money that took years to accumulate — often within a window of days. For a first-time buyer, the pressure to decide fast is real. The cost of deciding wrong is higher. This checklist exists so you have a structured process to follow before a single rupee leaves your account. Not a list of properties to consider. A list of actions to take, in sequence, on any property you are seriously evaluating.

Step 1: Establish the Legal Chain Before Anything Else

The most common mistake first-time buyers make is treating legal verification as the last step — something to hand off to a lawyer after they have emotionally committed to a flat. Reverse that sequence entirely. Legal clarity is a gate, not a formality.

Title Verification

  • Request the complete chain of title documents going back at least 30 years. In Gurgaon, where agricultural land conversions are frequent, gaps in this chain are a serious red flag.
  • Confirm the seller's name matches the registered ownership in Haryana's Jamabandi records (available at jamabandi.nic.in).
  • Check for any existing encumbrances — mortgages, liens, court attachments — via an Encumbrance Certificate from the Sub-Registrar's office covering the last 13 years minimum.

RERA Registration Check

  • Every under-construction project in Haryana must be registered under HRERA. Verify the RERA number at hrera.in.
  • Cross-check the registered carpet area against what the builder is quoting you. Super built-up figures are marketing; carpet area is what RERA governs.
  • Review the RERA project page for any registered complaints against the developer — this is publicly accessible and routinely ignored by buyers.

Step 2: Verify Approvals — the Exact Approvals, Not the Summary

Developers will tell you a project is "fully approved." That phrase means nothing without knowing which approvals, from which authority, and whether they cover the specific tower or floor you are buying on. In Gurgaon, approvals span multiple bodies — DTCP, HSVP, municipal corporations — and they do not always move in lockstep.

For ready-to-move properties, the Occupation Certificate is non-negotiable. Buying a unit without an OC means you are legally occupying an incomplete structure — and your home loan lender will eventually surface this problem, even if your enthusiasm does not.

Step 3: Deconstruct the Payment Plan and the Agreement

The Builder-Buyer Agreement (BBA) is not a formality — it is the only document that legally governs your relationship with the developer. Read it in full, or pay a property lawyer to annotate it for you. The cost of that review is a rounding error against your investment.

Clauses That Deserve a Line-by-Line Read

  • Possession date and grace period: Most BBAs allow a 6-12 month grace period before penalty kicks in. Know when your clock actually starts.
  • Penalty for delayed possession: RERA mandates compensation at SBI MCLR + 2% for delays, but only if you have not agreed to a lower rate in the BBA. Some agreements quietly dilute this.
  • Force majeure definition: Overly broad definitions — including "market conditions" — have been used to delay possession without penalty. Flag these clauses.
  • Super built-up vs. carpet area ratio: If the loading factor exceeds 25-30%, push back or get a written breakdown. Gurgaon projects have been known to carry 40%+ loading.
  • Maintenance deposit and society formation: Who controls maintenance until the Residents Welfare Association (RWA) is formed? What is the rate locked in?

Step 4: Physical Verification — Site Visit as an Audit

  • Construction stage vs. claimed stage: If the developer's payment plan has linked tranches to construction milestones, verify that the declared stage matches reality before releasing funds.
  • Neighbourhood infrastructure: Walk the last mile from the nearest metro station or highway exit. Time it. Gurgaon distances feel different at 8:45 AM on a Monday.
  • Water and sewage infrastructure: Confirm whether the project is connected to HSVP water supply or is running on tankers. Ask the site manager directly — this answer matters more than the clubhouse size.
  • Natural light and ventilation in your specific unit: Verify the orientation of your flat, not just the project. A south-facing unit on a lower floor with a building directly opposite is a different asset from the showroom experience.
  • Existing residents (for partially occupied projects): Talk to them. They will tell you things the sales team will not.

Step 5: Financial Verification — Liabilities That Travel With the Property

  • Existing home loan on the property: If the seller has an active mortgage, your purchase must include a simultaneous loan closure and document release. This is a coordinated process — not an afterthought.
  • GST applicability: For under-construction properties, GST at 5% (or 1% for affordable housing) applies. This is over and above the base price. Factor it into your total outflow calculation from day one.
  • Stamp duty and registration: In Haryana, stamp duty for women buyers is 5% vs. 7% for men — a meaningful difference on higher-value transactions. Confirm current rates with the Sub-Registrar's office, not the developer.
  • Home loan eligibility vs. property valuation: Banks conduct independent valuations. If the bank's valuation comes in lower than the agreed price, you fund the gap from your own pocket. Run a preliminary valuation check early.
