Moving Up from a 2BHK to a New-Build in Gurgaon: The Pre-Signing Checklist Most Upgraders Skip

You have lived in your 2BHK in Sector 56 or Palam Vihar long enough to know every crack in the plaster and every hour the water supply runs low. The upgrade decision is already made. What most upgraders underestimate is the gap between signing a new-build agreement and actually getting what was shown in the sample flat. That gap — in carpet area, in specifications, in delivery certainty — is where lakhs quietly disappear. This checklist exists to close it before you sign.

Why New-Build Upgrades in Gurgaon Fail Upgraders Specifically

Upgraders from older sectors carry a specific disadvantage: their reference point is a completed, tangible flat. A new-build is a promise packaged in a brochure, a sample flat, and a payment plan. The mismatch between expectation and delivery is not unique to Gurgaon — but Gurgaon's market makes it structurally worse.

That number is not a warning against buying new. It is a warning against signing without a method. The checklist below is that method.

Block 1: Legal and Title Verification (Before You Even Visit the Site Office)

Most buyers start with the sample flat. Start here instead.

RERA Registration

  • Search the project on hrera.org.in using the exact project name. Screenshot the registration certificate, noting the registered completion date — not the brochure's promised date.
  • Check whether the promoter has filed quarterly progress updates. Projects with gaps of two or more consecutive quarters without updates are a documented red flag.
  • Confirm the registered carpet area of your specific unit type on HRERA. Any variance from what the salesperson quotes is a compliance issue — and your negotiation lever.

Land Title and Encumbrance

  • Ask for the Jamabandi (Record of Rights) for the land parcel. The developer must share this on request — under RERA, it is a disclosed document.
  • Verify that the land is not under any court-ordered stay or ongoing litigation. A simple name search on the Punjab & Haryana High Court case status portal takes under ten minutes.
  • Confirm conversion of land use from agricultural to residential (CLU certificate) if the project is in sectors beyond the old municipal limits.

Occupation Certificate Status of Delivered Phases

  • If the project has earlier phases already delivered, check whether those phases hold a valid Occupation Certificate (OC) from MCG or DTCP. A developer who has not secured OC for Phase 1 before launching Phase 3 is a pattern worth noting.

Block 2: The Carpet Area Reconciliation Table

The single most common post-possession dispute in Gurgaon new-builds is carpet area shortfall. RERA mandates sale on carpet area — but brochures still routinely lead with super area numbers. Run this reconciliation before negotiating price.

In Gurgaon's current new-build market, loading factors range from 28% to 42% depending on project type. A high-rise with generous lobbies and double-height common areas will load heavily. If a developer quotes 1,800 sq ft super area for a 3BHK but HRERA shows 1,060 sq ft carpet area, the loading is 70% — significantly above market norm. This is a renegotiation point, not a dealbreaker in isolation, but it should recalibrate your per-sq-ft price comparison entirely.

Block 3: Specification Lock-In — What the Agreement Must Say

The sample flat is a marketing tool. The Agreement to Sell is the legal instrument. These two must match — and when they do not, the agreement governs.

Items to Verify Are Explicitly Named in the Agreement

  • Flooring brand and grade — not just "vitrified tiles" but the specific make and size (e.g., 800×800mm polished vitrified, Kajaria or equivalent Grade A). "Or equivalent" clauses must define the grade standard.
  • Kitchen platform material — granite thickness (minimum 18mm), edge finish, and whether the sink is included.
  • Bathroom fittings brand tier — Jaquar, Cera, Hindware are different price points. The agreement must name the brand or a verifiable equivalent tier.
  • Window system — UPVC or aluminium, glazing thickness, and whether mosquito mesh is included in the scope.
  • Electrical load sanctioned — for a 3BHK, anything below 5 kW sanctioned load will create real-world constraints. Verify this against the electrical layout drawing.
  • Car park type — covered stilt, basement, or mechanical stack. Mechanical parking systems have maintenance implications your older sector building never had.

What to Do If Specs Are Vague

Request a Specification Sheet as an annexure to the agreement, signed by the developer's authorised signatory. This is standard practice in well-governed projects. Resistance to this request is diagnostic.

Block 4: Construction Progress and Delivery Timeline Verification

Your pre-signing verification should make delay less likely to catch you off-guard, and give you contractual recourse if it does.

On-Site Construction Checklist

  • Visit the site unannounced — not during the developer's arranged site visit. Assess actual structural progress against the tower floor count committed for your possession quarter.
  • Ask for the latest HRERA quarterly progress report (Form REP-I or equivalent). The percentage of work completed declared here is a sworn submission — material deviation from visual reality is a red flag.
  • If the project is under construction, check whether the structural consultant is named and accessible. Reputed projects name their structural and MEP consultants in the brochure or on the HRERA filing.

Delay Penalty Clause — What to Read

  • The standard RERA delay penalty is SBI MCLR + 2% per annum on amount paid, for each month of delay beyond the registered possession date. Confirm the agreement reproduces this — or offers a higher rate.
  • Check whether the agreement includes a force majeure definition broad enough to exempt the developer from any monsoon, supply disruption, or regulatory delay. Overly broad force majeure language effectively nullifies the delay penalty.

Block 5: Financial Structure and Hidden Cost Mapping

When you sold or are selling your 2BHK, you had a clear number. New-build pricing adds layers that older resale transactions do not. Map every rupee before you sign.

  • Construction-linked plans (CLP) tie your payments to verified construction milestones — lower risk, standard for RERA-compliant projects.
  • Subvention schemes (EMI paid by developer until possession) carry interest risk if the developer defaults on EMI payments to your lender. Verify lender agreement terms independently.
  • Down-payment plans with large upfront sums in exchange for price discounts transfer maximum financial risk to you. Assess the developer's balance sheet — check MCA filings for the SPV — before accepting.
